⚡ Performance Notice
No speed guarantees: Real-world speeds may vary from 1 Mbps to 1 Gbps depending on network conditions.
Service Features:
- Best-effort service with no SLA or uptime guarantees
- Strict IRR and RPKI filtering enforced
- BGP sessions must be activated within 7 days
- Sessions must remain online (downtime > 7 days = deactivation)
3 Traffic Monitoring & Privacy
🔍 Privacy Notice
We reserve the right to monitor, inspect, and log your traffic 24/7 using any software, without prior notification.
- Traffic data may be collected and stored for analysis
- Data may be shared with third parties without notification
- Monitoring is performed for network security and abuse prevention
4 Prohibited Activities
🚫 Zero Tolerance Policy
Any violation results in immediate, non-refundable termination of service.
Strictly forbidden activities:
- Spam, scam, phishing, or mass mailing operations
- DoS/DDoS attacks, port scanning, vulnerability scanning
- Cryptocurrency or data mining operations
- Malware distribution or hosting
- P2P / BitTorrent traffic
- TOR nodes of any kind (entry, exit, relay)
- Content illegal in Germany or the United States
- Use of hijacked or unauthorized ASNs/IP prefixes
⚖️ Serious Violations
Using hijacked/unauthorized network resources results in lifetime ban and reputation reporting to relevant authorities.
5 Network Management & Abuse Handling
DDoS Protection:
- Incoming DDoS attacks lead to immediate null-routing or BGP shutdown
- Protection measures are automatic and non-negotiable
Abuse Response:
- Upon receiving abuse reports, affected IP addresses are immediately disabled
- Service remains suspended until issue resolution with client
- Outbound attacks or repeat complaints result in permanent termination
6 Payments, Donations & Refunds
💰 Payment Policy
The 1 Gbps upgrade (€4/month) is treated as a donation and creates no service level agreement.
- No refunds policy: All payments are final
- Service termination for TOS violations forfeits all payments
- Donations do not guarantee service availability or performance
7 Limitation of Liability
⚖️ Liability Disclaimer
Services are provided "as is" and "as available" without any warranties.
FoxDevLab Transit is not liable for:
- Direct, indirect, incidental, or consequential damages
- Loss of data, profits, or business opportunities
- Service interruptions or performance issues
- Third-party actions or network issues
This limitation applies even if we have been advised of the possibility of such damages.
8 Governing Law & Jurisdiction
This agreement is governed by the laws of the country where each party is domiciled:
- Germany: Laws of the Federal Republic of Germany; courts of Berlin
- Russian Federation: Laws of the Russian Federation; courts of Moscow
- Republic of Estonia: Laws of the Republic of Estonia; courts of Tallinn
All disputes shall be subject to the exclusive jurisdiction of the corresponding courts.
9 Changes to Terms of Service
We may update, modify, or replace these terms at any time without prior notice.
Continued use of the service after changes take effect constitutes acceptance of the new terms.
